Arkansas Best wins appeal, moves forward with suit against YRC

It took a few months, but Fort Smith-based Arkansas Best Corp. (NasdaqGS:ABFS) received word on Wednesday it can move forward with its lawsuit against YRC Worldwide (NasdaqGS:YRCW) of Overland Park, Kan.
Arkansas Best and YRC are competitors in the the less-than-truckload freight segment and both employ drivers who are members of the International Brotherhood of Teamsters. Arkansas Best filed suit in federal court last year against YRC, claiming the company negotiated concessions with the Teamsters that gave the trucking company an unfair advantage in the market. ABF decision may not be out until July

Fort Smith-based Arkansas Best Corp. (Nasdaq: ABFS) may not learn if it was successful in its appeal in a case against the International Brotherhood of Teamsters.
Arkansas Best — the parent company of less-than-truckload carrier ABF Freight System — filed suit in federal court last year against the Teamsters. Arkansas Best alleged the Teamsters worked out concessions with a competitor, YRC Worldwide (Nasdaq: YRCW), that put ABF at an unfair disadvantage in the market. ABF decision pending

Fort Smith-based Arkansas Best Corp (NasdaqGS:ABFS) appealed the dismissal of its lawsuit against the International Brotherhood of Teamsters and had its day in court this morning.
The company is still waiting on a ruling, said spokesman David Humphrey, adding ABF officials aren’t sure when the panel of judges who heard the appeal will come to a decision on the case.
